TERMS OF PURCHASE

1. About Schiacciata AB

The app and/or e-commerce site Bar Schiacciate (”the App/E-commerce Site”) is provided by Schiacciata AB, organization number 559429-8423 (”the Seller”, ”we”, or ”us”). If you wish to contact us, you will find our contact information under section 12 below.

2. About the purchase terms and purchases via the App/E-commerce Site

These purchase terms apply to the ordering and purchase of products and services via the App/E-commerce Site. Purchase agreements are initiated via the App/E-commerce Site and shall be deemed concluded when we have confirmed your order in an order confirmation or, if earlier, when you have started using an ordered service.

3. Prices and products

Prices for products and services are stated inclusive of VAT in the specified currency. The total price, including all fees such as shipping fees, handling fees, and similar, will be presented at checkout.
Our goal is to always keep the App/E-commerce Site updated with any changes in the product range, but we reserve the right that certain products may be out of stock. We strive for all prices and product descriptions on the App/E-commerce Site to be completely accurate, but we reserve the right for any errors.

4. Ordering

Orders are placed in the App/E-commerce Site. When ordering, email address, name, and phone number must be provided. All personal information provided when ordering must be correct and pertain to the person ordering the products. We are not responsible for non-delivery due to insufficient or incorrect information provided during the order. All your orders can be found under History in the App or via email for the E-commerce Site.

5. Payment

The payment methods available for each product or service are presented at checkout. Payment is made by card, Swish, or by other means in accordance with the purchase and payment terms applicable to each payment method, as stated at the time of purchase. A receipt will be sent electronically to your provided email address.

Card Payment

We accept payment with Visa, MasterCard. Your payment card will be debited immediately.
Card payment requires the customer to register one or more payment cards or other payment methods by entering card information in the App/E-commerce Site. For payment cards, card number, expiry date, and security code/CVV code must be registered.

Payment with Swish

We accept payment with Swish. The linked phone number provided during payment will be debited immediately. When paying with Swish, you will be prompted to open the Swish app and authenticate with your e-ID.

6. Order confirmation and delivery

Once we have received your order, we will confirm this directly in the App/E-commerce Site. When your order is confirmed and ready for delivery, you will receive an order confirmation in the App/E-commerce Site.
Available delivery options are presented at checkout; you select the delivery option yourself when placing your order.

7. Cancellation (right of withdrawal)

When shopping via the App/E-commerce Site, you have the right, according to the Distance Contracts Act, to withdraw from the order (right of withdrawal) by notifying us within 14 days. For service purchases, the period counts from the order; for product purchases, it counts from the time you received the product. We will then refund the fees you have paid for the relevant product or service. You will be responsible for the return shipping costs when the product is sent back.

The right of withdrawal applies only on the condition that (i) the product is returned in undamaged condition, or (ii) that we have not commenced delivery of the service for which you wish to withdraw an order. Please note that the sale of food is not covered by the right of withdrawal. You can read more about the right of withdrawal and which goods and services are exempt from the right of withdrawal on the Swedish Consumer Agency's website, where forms for exercising the right of withdrawal are also available.

8. Product guarantees

We do not provide any guarantees on the products you purchase and order from us, but you always have the right to complain about a faulty product within three years of your purchase (see section 9). To the extent that a manufacturer of a product provides guarantees, such guarantees naturally apply to the product.

9. Complaints

When you receive your products, it is important to check that they are not damaged or faulty. If you believe that a delivered product or service is faulty, you must complain about the product or service within a reasonable time by contacting us. We will then investigate the complaint and notify you if we can accept it and, if so, how we will remedy the defect, e.g., through redelivery, price reduction, or refund. Any refund will be made as soon as possible and no later than 30 days from the date the complaint was finally processed.

10. Intellectual property rights

Your use of the App/E-commerce Site does not transfer copyright or other intellectual property rights to you. You may not use, copy, modify, or otherwise handle software or other material belonging to us or our partners (including, but not limited to, information and images made available via the App/E-commerce Site), nor may you transfer or license such software or material to others.

11. Personal data processing

To receive, manage, and deliver your order, the Seller will process your personal data. All our processing of personal data takes place in accordance with current personal data legislation. You can read more about how we process your personal data on our website here.

13. Force Majeure
We are not liable for damage or failure to perform due to strikes, fires, governmental acts, labor disputes, accidents, errors or delays by subcontractors, disruptions in public communication systems, or other circumstances beyond our control that we could not reasonably have foreseen and whose consequences we could not reasonably have avoided or overcome. If a circumstance in accordance with this section 13 persists for a period exceeding 1 month, a party has the right to terminate with immediate effect any purchase agreement whose performance is hindered by such circumstance.

14. General limitation of liability

Our liability for delivered products and services assumes that they are used as intended. Our other liability for damages that may arise as a result of defects in products and services that we deliver is limited to what follows from applicable mandatory legislation.
Unless mandatory law stipulates otherwise, we are in no case liable for indirect damage or loss, and our liability to compensate you is, unless intent or gross negligence is present, limited to the compensation you have paid for the product or service in question.

To be eligible for any compensation for damage, your request for compensation must be made within a reasonable time from when the damage was discovered or ought to have been discovered.

15. Changes to contractual terms

We reserve the right to change these general terms and conditions from time to time. For completed purchases, the terms and conditions that have been approved and accepted by you in connection with the current purchase always apply.

16. Disputes and applicable law

Disputes concerning the validity, interpretation, and application of these purchase terms shall primarily be resolved through negotiations between the Seller and you as the customer. If such negotiations do not lead to the resolution of the dispute, the dispute may, at your request, be reviewed by the National Board for Consumer Disputes, ARN. The dispute may also be tried by a general court, in which case Swedish law shall apply.
